			<content:encoded><![CDATA[<p>The Asbestos Disease Awareness Organization (ADAO) and other asbestos advocates throughout the United States will be celebrating National Asbestos Awareness Week during the first week of April.</p>
<p>Thanks in large part to Senator Max Baucus (D-MT) and other cosponsors, the Senate was able to introduce the sixth annual resolution that declares the first week of April National Asbestos Awareness Week.</p>
<p>The ADAO, which was founded by asbestos victims and their families in 2004, aims to protect the rights of those affected by asbestos-related disease while raising public awareness about the hazards associated with asbestos exposure.<br />
<span id="more-2265"></span><br />
Malignant Mesothelioma, a rare cancer that typically develops in the lining of the lungs, will be one of the many topics discussed at ADAO’s upcoming International Asbestos Conference. The conference is scheduled to begin on April 10, 2010 in Chicago Illinois.</p>
<p>Linda Reinstein, Executive Director and Co-Founder of ADAO, said, “We are grateful to the U.S. Senate to have the opportunity to help raise the level of public awareness about the prolific dangers of asbestos and further unite doctors, scientists and public health advocates during National Asbestos Awareness Week for this important effort. During the past six years, ADAO has seen the progress and indeed, this confirms what Americans deserve and want. We know asbestos prevention and education will save lives and dollars.”</p>
<p>People are most commonly placed at risk of asbestos exposure when asbestos-containing materials are damaged or disturbed and the microscopic fibers that make up asbestos are released into the air. Once these fibers become airborne, the chances of inhaling them increase significantly as they can remain in the air for quite some time depending on conditions.</p>
<p>In addition to mesothelioma, inhaling asbestos fibers is also known to cause lung cancer and asbestosis. While the effects of these illnesses may take several decades to arise, prognosis is often poor because they are typically diagnosed during the latest stages of development.</p>

Yet, it is these complications that lead physicians to discover the unique features of a given disease, that, once isolated, make it possible to identify the specific disease and make a diagnosis.</p>
<p>Diagnosis</p>
<p>And, so it is with mesothelioma. Diagnosis starts with a medical history review, examination, and diagnostic testing. During your medical history review and examination you will learn facts that he will use as clues to direct him. Your symptoms, your work history, and likelihood of exposure to asbestos and other facts, combined, will give him an idea what to look for, and thus, a list of diagnostic tests to run that will give him the foundation for a his diagnosis. If he suspects mesothelioma, you can expect the following list of tests to be done:<br />

<p>• X-rays of chest, abdomen or both</p>
<p>• Pulmonary function tests (to measure breathing capacity)</p>
<p>• CAT scan or MRI</p>
<p>• Biopsy (if a mass is present it is needed to confirm a mesothelioma diagnosis)</p>
<p>Progression of Mesothelioma</p>
<p>Once mesothelioma is diagnosed, its progression is measured by classifying symptoms into four stages, called staging. Staging systems measure the extent that the primary mass has spread within the body. It does not account for secondary tumors or complications caused by the cancer. All staging systems describe the stages that originate from the pleura, since over 80% of mesothelioma cases manifest in the pleura. Only two are used for peritoneal mesothelioma. The Butchart System is not used to stage peritoneal mesothelioma or mesothelioma originating in other organs (see TNM system.)</p>
<p>Staging</p>
<p>Of the three main staging systems for mesothelioma, the Butchart System, named for Dr. Eric Butchart who developed it, is the oldest.</p>
<p>Stage 1</p>
<p>At this stage, the primary tumor is isolated to the pleura on one side or the other, and possibly the diaphragm on that same side. It may also have reached the pericardium, the mesothelial membrane encasing the heart.</p>
<p>Stage 2</p>
<p>At this stage the primary mass is present in both lungs, and may have spread to other organs or lymph nodes within the chest cavity.</p>
<p>Stage 3</p>
<p>The primary mass has entered the peritoneum through the diaphragm. It may also have spread to lymph nodes outside of the chest cavity.</p>
<p>Stage 4</p>
<p>This stage is called “distant metastatic cancer” as it has spread to other parts of the body by way of the blood stream.</p>
<p>Treatment of mesothelioma varies by stage ranging from surgery, radiation and clinical trial in Stage I, to draining the excess fluid from the chest or abdomen, palliative surgery, radiation therapy, chemotherapy, or a clinical trial of a combination of these treatments.</p>

However, there are similarities in the treatment of mesothelioma and relief of symptoms of pleural mesothelioma, pericardial mesothelioma and peritoneal mesothelioma.<br />
<span id="more-2261"></span><br />
Almost all patients with cancer, including mesothelioma patients, cancer, painful experiences breathing difficulties during the last stages of cancer. Medical studies have shown that no less than 70% of patients with terminal cancer experience pain, breathing difficulties. In diseases such as mesothelioma of the pleura, pericardial mesothelioma and lung cancer, difficult breathing and shortness of breath occurs at all stages of cancer, not just the final step.</p>
<p>Difficulty breathing is for mesothelioma patients, caregivers and family members fearful. The fear of imminent death and powerlessness suddenly, unexpectedly, much more real. Mesothelioma relieve symptoms of respiratory distress should include emotional support as well as relieving physical symptoms. Relaxation techniques should be taught, and it should be stressed that there must be adjustments in daily activities to reduce breathing difficulties. Changes in lifestyle to control respiration mesothelioma, and most tenacious of patients with mesothelioma should be convinced that this is the best treatment of mesothelioma for them. <p>Researchers think that they can be dangerous to anybody who works with or close to them because the fibers from the asbestos are able to be inhaled. This can induce diseases of the lungs and other vital organs. Unluckily these serious diseases do not always appear until much later in life from the time when the people were exposed.</p>
<p>In some people it is able to make scar tissue to back up in their lungs and make it tricky and nearly impossible to breathe. The fibers that are able to cause these problems are too small for people to observe them without microscopes.</p>
<p>Who is at risk? Individuals who smoke are at an increased risk of acquiring these diseases. Also people who work un large industries and produce things that contain products utilizing it are at a great risk. Construction workers can also be exposed to large amounts of the fibers that come from the building materials that they utilize each day.</p>
<p>Besides the decrease in lung cancer several health experts think that asbestos is able to induce colon cancer. This is an on going study that has not been fully tested &#8211; but some think that it is able to be caused from drinking tap water and insulation utilized in the home. Statistics show that 26 out of 2,500 textile workers that utilized asbestos products died from colon cancer.</p>

When swallowed or inhaled asbestos can stay in the human body producing toxic effect which may result in a number of serious diseases, such as asbestosis, Mesothelioma (Mesothelium cancer), lung cancer, gastrointestinal cancer, colorectal cancer, and other illnesses.</p>
<p>Mesothelioma (also known as &#8220;asbestos cancer&#8221;) is a most common asbestos-related type of cancer. The Mesothelium is a cellular membrane lining certain cavities of the human body. Mesothelioma may develop in lung, abdominal, scrotal, and heart sac cavities, the four types of M. being called Pleural, Peritoneal, Testicular, and Pericardial. In 70 percent of cases Mesothelioma is pleural in origin.<br />
Up to 3000 cases of malignant Mesothelioma are registered in the United States every year.<br />

In the year 2006 case, a New York jury judged Chrysler-Daimler to be at 10% fault. The jury also judged the car company to have acted with reckless disregard, meaning that Chrysler could be held liable for the entire amount of money under the Law of New York.</p>
<p>Determination of Liability</p>
<p>New York follows a pure comparative liability system in determining liability in personal injury suits. Under a pure comparative liability system, a plaintiff may recover some damages even if they are judged to be up to 99% responsible for their own injury. However, if the plaintiff is judged to be at fault in their own injury, the award for damages is reduced in proportion to their fault in the case. Thus, if the jury finds that the damages in a case amount to $10,000 and the plaintiff is 40% liable, the plaintiff can recover $6,000.</p>
<p>New York courts adopt a modified joint and several liability system in giving awards in cases where there are multiple defendants. Defendants may be held jointly liable for economic damages. When determining the responsibility for non-economic damages, any defendant who is 50% or less responsible for the plaintiff&#8217;s injuries is subject to several liability, and can only be held responsible for the portion of damages that corresponds to their portion of the blame. Any defendant who is determined to be more than 50% responsible for the defendant&#8217;s injuries is subject to joint and several liability, and can be held liable for the entire amount of the award.</p>

He alleged that his work stripping brake linings exposed him to asbestos which caused his mesothelioma. Verdict: Plaintiff, $25 million</p>

Consolidated Edison, KeySpan Corporation and Long Island Lighting Company: Robert Crouteau was a 54 year old former boilermaker who developed mesothelioma after being exposed to asbestos on the job for ConEd, KeySpan and Long Island Lighting. He was diagnosed with pleural mesothelioma in 2001, and filed suit against the three companies. Verdict: Plaintiff, $47 million</p>
<p>-1993 &#8211; Consorti, Luchnick, Pulizzi, Tabolt v. LIRR: Four plaintiffs with mesothelioma in a consolidated trial before the New York Southern District Court Verdict: Plaintiff, $47.5 million</p>

<p>Although severe, mesothelioma is still a rare type of cancer. About one person in a million is affected. In 2004, it was estimated that around 15 individuals to 1,000,000 were victim of the disease in the United States. No one knows for sure the percentage of this year, 2008, since the number is increasing. However, about 200,000 individuals die each year from cancers causing by carcinogenic workplaces, including job sites containing asbestos fibers, according to the World Health Organization (WHO).</p>
